2. Description of the Service

Kotka Cost Estimate is a construction cost estimation and project management service offering calculation modules, an AI-assisted renovation advisor, schedule management, investment calculation, carbon footprint calculation, and automated document generation (PDF and Excel). The service is intended for professional use in the construction industry.

3. Right of Use and Registration

• Use of the service requires registration and an active subscription
• Users are responsible for the confidentiality of their credentials and all actions performed under their account
• Minors (under 18) may not register without parental or guardian consent
• Big Qwerty Oy reserves the right to reject or close a user account without specific cause

4. Pricing and Subscriptions

All prices include VAT (25.5%). Payments are processed via Stripe. By accepting these terms you also accept Stripe's terms of service.

5. Free Trial and Cancellation

• The per-user subscription includes a 14-day free trial — no credit card required during the trial
• You may cancel your subscription at any time before the end of the billing period — cancellation takes effect at the end of the current period
• Per-project one-time payments are refundable within 14 days of purchase if the project has not been started

6. Acceptable Use

The service must not be used for:

• Illegal activities or infringement of third-party rights
• Excessive load on the service (automated queries, scraping)
• Reselling or sublicensing the service without written permission
• Distributing malware or breaching information security

7. Intellectual Property

The software, brands, logos and content related to the service belong to Big Qwerty Oy or its licensors. Users receive a limited, non-exclusive right to use the service in accordance with these terms. Data entered by users into the service belongs to the user.

8. Limitation of Liability

The service is provided "as is". Big Qwerty Oy does not guarantee uninterrupted or error-free operation. We are not liable for indirect damages (loss of revenue, business interruption) or for the accuracy of cost estimates — they are estimates, not binding calculations. Our liability is limited to subscription fees paid during the preceding 12 months.

9. Service Changes and Suspension

Big Qwerty Oy may modify, suspend or discontinue the service in whole or in part. Users will be notified of material changes at least 30 days in advance by email. In the event of discontinuation, prepaid subscription fees will be refunded for the remaining period.

10. Termination

Either party may terminate the agreement at any time. Big Qwerty Oy may close an account immediately if a user materially breaches these terms.

11. Governing Law and Dispute Resolution

These terms are governed by Finnish law. Disputes shall be resolved primarily through negotiation. If negotiations do not lead to a resolution, disputes shall be settled by the District Court of Helsinki. Consumers also have the right to refer matters to the Consumer Disputes Board.

12. Changes to These Terms

We reserve the right to amend these terms. Users will be notified by email at least 14 days before changes take effect. Continued use of the service after changes constitutes acceptance of the updated terms. Last updated: 1 March 2025.
